Terms and Conditions (T) for Courier Service Agreements

Scope of Application
These TCs apply to all employment relationships between Assaf GmbH, Mergenthalerallee 15–21, 65760 Eschborn, and its employed courier drivers.

Subject Matter of the Agreement
The employment relationship is permanent and part-time, not subject to collective bargaining agreements. The activity primarily involves the delivery of food, groceries, medications, or similar goods on behalf of customers.

Start of Employment and Probationary Period
The start of employment will be individually agreed upon. The first 12 months are considered a probationary period. During this time, the employment relationship can be terminated by either party with two weeks’ notice.

Working Hours and Assignment
The monthly working hours will be determined individually. The place of work is determined by the employer. There is no entitlement to freely choose the work location. Overtime, night, Sunday, and public-holiday work are possible within statutory limits.

Remuneration
Remuneration is paid as a monthly gross salary, which is transferred to the bank account specified by the employee on the last calendar day of the month. The employee undertakes to repay any payments received unlawfully.

Vacation
The statutory vacation entitlement is 20 working days with a 5-day week. Vacation planning is carried out in consultation with the employer. Illness during vacation must be proven by a medical certificate.

Illness and Proof of Obligation
The employer must be notified of illness immediately. A medical certificate must be presented from the third day of illness. Special reporting obligations apply in the event of prolonged illness abroad.

Privacy Policy
Assaf GmbH is committed to protecting personal data. Courier drivers are obliged to comply with the GDPR when processing personal data (e.g., customer data).

Workplace Conduct
The employer’s instructions and company rules, especially regarding dress code, use of company equipment, and communication with the press, must be observed.

Confidentiality and Non-Compete Clause
All confidential information must be kept secret even after the termination of the employment relationship. The employee may not engage in any competing activity during the ongoing employment relationship.

Special Provisions & Work Equipment
Optionally, fuel cards or company bicycles may be provided. These remain the property of Assaf GmbH and must be returned upon termination of the contract. Their use is permitted exclusively for business purposes.

Continuing Education
Assaf GmbH offers mandatory training courses, especially regarding app usage and customer communication. Wages will continue to be paid during training.

Termination
After the probationary period, the statutory notice periods apply. Terminations must be made in writing. The employer may, under certain conditions, grant a release from duties.

Final Provisions
The contract is exclusively subject to German law. Amendments require written form. No verbal collateral agreements exist. Upon termination of the contract, all work equipment must be returned.
